Delegate Terms and conditions

This agreement applies to and between you, the attendee of our

Facial Aesthetic & Gynaecology Event Series and BAFA London Ltd. (Company no. 13718501)

The terms hereby apply to any person, firm, company or other entity specified on the registration form for the Event (each the “delegate”) and BAFA London Ltd (“Us”, “We”, or “Our”).

As an attendee of this event, you are required to read these terms and conditions carefully as they contain important information.  By submitting your registration and/or by attending an Event, you agree to be bound by these terms and conditions.

In this Agreement “you” and “your” refer to our Delegates and prospective delegates. “we”, “company”, “us” and “our” refer to BAFA London Ltd.  Any and all attendance to our event is subject to this Agreement, which may be updated by us from time to time without prior notice to you. Any change of terms shall be binding and effective upon posting of the revised Agreement on our website. In addition to this Agreement, specific services or information contained on our website (https://bafa.events) may be subject to additional posted terms or guidelines applicable to such services. All such terms or guidelines are hereby incorporated by reference into this Agreement.

Terms

1. Your registration (whether submitted directly by you or on your behalf) is an indication of your interest to attend the event. The registration and acceptance to attend the event shall be at the discretion of BAFA London. We shall within 5-14 days confirm in writing (either via email or other forms of communication you have provided to us) if your registration has been received and attendance confirmed. Should you not receive a notice from us within the said 14 days, it can be assumed we have successfully registered you for the event. We reserve the right to refuse or withdraw any registration after confirmation without liability.

2. You agree to pay all delegate fees as may be specified when booking for the event. Payment of delegate’s fees must be received in full not later than 72 hours before the Event. If payment of delegate’s fees in full is not received before the Event, we may at our sole discretion either require such payment as a condition of the delegate’s entry to the Event or refuse the delegate’s entry to the Event. No refunds of any proportion of delegate’s fees already paid (if any) will be made and any balance of delegate’s fees will remain due and payable where entry to an Event is refused as described under this Clause 2.

3. BAFA London reserves the right at any time to change the format including, without limitation, content, location, venue, opening hours, duration, dates, timing, guest speakers and/or any other aspect of the Event, in each case without liability.

4. Should the event date change at any time and for any reason (whether or not due to causes beyond our reasonable control) within twelve (12) months of the originally scheduled date of the Event, or where the Event is cancelled but is reasonably expected by BAFA London to be held at any time in the next calendar year, then, unless we notify you otherwise, your registration will be deemed to be valid for the Event on the new date(s) or when it is next staged (as applicable) in the same way that it would have applied to the originally scheduled Event (and no refund of any paid registration fees will be issued).  Where all or part of the Event is cancelled and is not reasonably expected by BAFA London to be held in the next calendar year, then your registration will no longer be deemed to be valid for the Event (or the cancelled portion of the Event, as applicable) and, at your election, any paid registration fees for the Event (or the cancelled portion of the Event, as applicable) will be refunded or a credit note issued for the same, and you will be released from paying any further amount of registration fees for the Event (or the cancelled portion of the Event, as applicable). Service charges are non-refundable.  Personal arrangements, including, without limitation, travel and accommodation, are at your own risk and BAFA London will not be liable for any costs relating to such arrangements, even if the Event is cancelled or moved to a new date(s).  You acknowledge and agree that the provisions of this paragraph set out your sole remedy in the event of cancellation or the changing of the date(s) of the Event and all other liability of BAFA London is hereby expressly excluded.

5. Delegates may cancel registration in accordance with this clause 5 by sending an email to info@bafa.london. The following shall apply in the event of a cancellation request:

• 50% refund should the request occur within 1 month but less than 15 days to the event date
• 80% refund if the request occurs up to 1 month from the event date.

Any request to cancel a registration within 15 days before the first day of the relevant Event shall be non-refundable. No refunds or other credits will be given in respect of attempted cancellations received after this date and any outstanding balance from the delegate’s fees shall remain payable.

6. In the event of a Force Majeure or other reasons beyond the control of BAFA London which may have an adverse impact on the ability to carry on with the Event on the specified date and/or time, we shall at our sole discretion provide an alternative date/time for the Event. The Delegate shall not be entitled to object to such rearranged or rescheduled Event or have any right to claim any compensation in respect thereof. Should we not be able to perform our obligation under this Agreement or reschedule the event as specified under this clause, then the delegate will (as its sole remedy) be entitled, in its sole discretion, to receive either a refund or credit note in respect of delegate’s fees received by BAFA London, in each case less an administration charge equivalent to 20% of delegate’s fees. For the purpose of this Agreement, a Force Majeure Event means any event arising that is beyond the reasonable control of BAFA London including (without limitation) speaker cancellation or withdrawal, supplier or contractor failure, royal demise, venue damage or cancellation, health scares, pandemic (such as the COVID-19), industrial dispute, governmental or public health authority regulations or action, military action, fire, flood, disaster, civil riot, acts of terrorism or war. These terms and conditions shall apply in respect of any rearranged or rescheduled Event pursuant to this Clause 6.

7. All unauthorised filming, sound recording and photography of the Event, and all unauthorised transmission of audio or visual material at the Event, by you, is expressly prohibited. You agree: (a) to surrender to BAFA London or destroy on demand any material in whatever media recorded in violation of this paragraph, (b) that the copyright and other intellectual property rights in any such material shall vest in BAFA London unconditionally and immediately on the creation of such material, and (c) to hold BAFA London and all its affiliates, employees and representatives harmless against any claims made in respect of such unauthorised activities.

8. You hereby grant to BAFA London the consent to filming, sound recording and photography at the Event, which may include, without limitation, filming, sound recording and photography featuring your image (the “Content”). You acknowledge and agree that BAFA London is the sole and exclusive owner of all rights in the Content and hereby waive any and all: (a) rights in and to such Content, and (b) claims that you may have relating to or arising from the Content and/or its use.  Without limitation, BAFA London shall be permitted to use the Content anywhere in the World for promotional and other purposes, without any payment or compensation.

9. Our website may contain links to other websites. Unless expressly stated, these websites are not under the control of BAFA London or of our affiliates. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of their use. The inclusion of a link to another website on this Site does not imply any endorsement of the websites themselves or those in control of them.

10. Your safety when using our website is paramount to us. Hence, all reasonable skills and care shall be taken to ensure your safety when using our Website. Please kindly note that whilst your security is paramount to us, remember that no method of transmission over the Internet, or method of payment is 100% secure. While we strive to use commercially acceptable means to protect your transactions on our website, we cannot guarantee its absolute security.

11. We make no guarantee of any specific results from our Event. Our Events are provided “as is” and we do not make any guarantee that they shall be fit for a particular purpose or that they will be suitable for you or third parties that might be attending. You partake of this Event at your discretion and risk.

12. We shall not be held liable for any loss, damage or injury suffered due to your negligence or omission or the negligence/omission of your representative. We reserve the right to remove any person from the Event who fails to comply with these terms and conditions or who, in the opinion of BAFA London, represents a security risk, nuisance or annoyance to the running of the Event.

13. To the fullest extent permitted by the applicable law, BAFA London shall not be liable to delegate for any loss, delay, damage or other liability incurred resulting from or arising in connection with the cancellation or date change of the Event, howsoever arising, or any venue change. Service charges are non-refundable.

1. For virtual Events only:(a) delegate undertakes to be responsible for any technical requirements needed to enable the delegate to access the Event website, app or other platforms (the Event Platform)made available to facilitate participation in the Event. We do not: (i) guarantee that the Event Platform will operate continuously, securely or without errors or interruption; (ii) accept any liability for its temporary unavailability; or (iii) guarantee that the Event Platform and/or any content thereon (including, without limitation, any content available for download) will be free from viruses, infections, Trojan horses, worms and/or any other code that has contaminating or destructive properties. The Delegate must not attempt to interfere with the proper working of the Event Platform (for example, by attempting to circumvent security or tamper or hack into or otherwise disrupt any computer system, server, website, router or any other internet-connected device). Delegates agree to comply with any website terms of use and/or fair or acceptable use policies indicated on any website on which the Event Platform is hosted; (b) BAFA London does not endorse or accept any responsibility for the content, or the use of, any goods or services that may be identified or described on the Event Platform and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of, or reliance on, any content, goods or services available on or through the Event Platform or any website or other resource referenced therein; (c) We may issue delegates with a username and password. Usernames and passwords are confidential and remain our property and may not be sold, assigned or transferred to any third party without BAFA London’s permission. The Delegate’s usernames and passwords are personal to them. Delegates hereby agree that they will not permit others to use their username or password and remain liable for the acts of any person using their username and password; (d) any posts, messages or other materials, information or data supplied or uploaded by a delegate to the Event Platform (collectively, Materials) will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such Materials for any purpose. Delegates hereby waive any moral rights in any Materials to the extent permitted by applicable law. BAFA London reserve the right, at its sole discretion, to edit or remove postings to any message boards on the Event Platform and delete or use electronic methods to block or filter any Materials at its discretion but does not have any obligation to do so. Delegates shall not make libellous postings or any postings that are illegal or infringe the intellectual property rights of any third party. We will not be responsible for monitoring Materials for compliance with law; (e) delegates may use the Event Platform solely for access to the Event. Without limitation, delegates must not (i) download, store, reproduce, transmit, display, copy, distribute, exploit or use the Event Platform and/or any content thereon for their own commercial gain, (ii) use the Event Platform and/or any content thereon in any manner other than in compliance with law and these terms and conditions, (iii) infringe our intellectual property rights or those of any third party in relation to delegate’s use of the Event Platform and/or any content thereon, (iv) transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation, and/or (iv) knowingly transmit, send or upload any data that contains viruses, infections, Trojan horses, worms and/or any other code that has contaminating or destructive properties; and (f) BAFA London is under no obligation to oversee, monitor or moderate any interactive service provided on the Event Platform and, without limitation, expressly excludes all liability for any loss, injury or damage whatsoever arising from the use of any interactive service by any user, whether the service is moderated or not.
2. Whilst we do our best to ensure this website is secure and free of errors, viruses and other malware, all users are advised to take responsibility for their security, personal details and computers.

16. Substitutions with employees from the delegate’s organisation are welcome at any time before the Event start date, but in all other respects, the registration of the delegate is issued for the delegate’s personal use only and cannot be shared with any person during the Event. The Delegate may not purchase registrations as an agent for any third party, sell or otherwise transfer its registration to others or exploit its registration commercially or non-commercially in any way.

17. We may require you to provide Personally Identifiable information such as your name, phone number, email etc. We will be holding this information on a database and, where we have appropriate authorisation/justification (which may include, without limitation, express/implied consent or legitimate interests), may be shared with other entities that require such information to provide services to you e.g., third parties who assist with organising the event and for promotional and other purposes. Your personal information may also be shared with government entities and regulatory authorities as required by law.  At some Events, exhibitors and sponsors may use lead capture applications or barcode scanner devices.  If you choose to allow your badge (whether physical or digital) to be scanned by third parties at the Event, we may pass your personal information to such third parties.  Further, there may be certain areas of the Event at which your attendance is conditional on your personal information being provided to third parties that have sponsored or are managing such areas.  The use that any third parties make of your personal information is outside of BAFA London’s control and, to the extent permitted by applicable law, we do not accept any liability in this regard.

18. The Events are not intended for children under the age of eighteen (18). Thus, we have the right at our sole discretion, to refuse registration, entry/admission or remove any person who fails to meet this age requirement.

19. BAFA London reserves the right to modify this website, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the website following the changes.  If we are required by law to make any changes to Terms and Conditions, these changes will apply automatically to any transaction currently pending in addition to any transaction placed by you in the future.

20. To the maximum extent permitted by law, BAFA London accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of this website, any information contained therein or attending our events. Delegates should be aware that they attend the events and use this website at their own risk. We accept no liability for any disruption or non-availability of this website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, third party (such as zoom or other meeting platforms) server failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

21. Should you be selected as a participant in an activity at the event, you understand that any such participation shall be at your discretion. You hereby release and hold harmless BAFA London from any and all liability, damage, expense, cause of action, suit, claim and judgment arising from injury, damage or loss to you or your personal property which may arise out of your participation in such activity.

22. You agree to irrevocable release, indemnify, hold harmless and defend BAFA London, our agents, representatives, consultants, affiliates and employees from and against any and all claims of whatsoever kind or nature, and for any loss, damage, or injury, including but not limited to, financial, personal, emotional, psychological, medical, or otherwise which you may incur arising at any time out of or in connection with attending our Events.

23. Any default, delay or omission of any of the provisions of this Agreement by either Party will not be construed as a waiver of any subsequent breach of the same or other provisions. We are entitled to still pursue any omitted or failed payment by you at any time.

24. In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.

25. Any dispute between Delegates and BAFA London arising from this Agreement shall be resolved through mediation if not resolved informally by the parties within 15 days of the dispute arising. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted by an expert arbitrator agreed upon by the parties. The cost of mediation and arbitration shall be borne by the party bringing the dispute or claim.

26. These Terms and Conditions and the relationship between you and BAFA London shall be governed by and construed in accordance with English laws and you agree to submit to the exclusive jurisdiction/courts in England.
